Terms of Use

1. What RentClear is

RentClear is a web application that helps UK private landlords comply with Making Tax Digital for Income Tax (MTD ITSA). It allows you to record rental income and expenses, and submit quarterly updates to HMRC on your behalf via their Making Tax Digital API.

RentClear is a software tool. It is not a tax adviser, accountant, or legal adviser. Nothing in the service constitutes tax or financial advice. You remain responsible for the accuracy of all data you submit to HMRC.

2. Who can use RentClear

RentClear is intended for:

  • UK resident individuals who receive rental income from UK residential property.
  • Individuals who are within scope of Making Tax Digital for Income Tax (gross qualifying income above the relevant threshold).

RentClear does not support limited companies, trusts, or non-residents. It does not support self-employment income or any income source other than UK property rental income.

You must be at least 18 years old to create an account. By using RentClear, you confirm that the information you provide is accurate.

3. Your account

You are responsible for maintaining the security of your RentClear account credentials. You must not share your login with any other person. You are responsible for all activity that occurs under your account.

When you connect your HMRC account to RentClear, you authorise us to submit quarterly income and expense data to HMRC on your behalf. You can revoke this authorisation at any time by disconnecting your HMRC account in settings.

4. Acceptable use

You agree not to:

  • Submit false or inaccurate information to HMRC.
  • Attempt to access another user's account or data.
  • Interfere with the operation of RentClear or its underlying infrastructure.
  • Use RentClear in any way that violates applicable law, including tax law.
  • Reverse-engineer, decompile, or attempt to extract the source code of the application.

5. Your responsibility for accuracy

You are solely responsible for the accuracy and completeness of all income and expense data you enter into RentClear. HMRC submissions are made based on the data you provide. RentClear does not verify the accuracy of your records against bank statements, agent statements, or any other external source.

HMRC penalties for inaccurate or late submissions are your responsibility. RentClear is a submission tool, not a guarantee of compliance.

6. Subscription and payment

RentClear requires a paid subscription after any applicable trial period. Subscription fees are as displayed on the pricing page at the time of purchase. Payments are processed by Stripe.

Subscriptions renew automatically at the end of each billing period. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods.

7. Service availability

We aim to keep RentClear available at all times but cannot guarantee uninterrupted access. Scheduled maintenance, third-party outages (including HMRC API outages), or unforeseen technical issues may cause temporary unavailability.

HMRC's APIs are operated by HMRC, not by RentClear. We cannot control HMRC system availability or the outcome of submissions once they are accepted by HMRC's systems.

8. Limitation of liability

To the maximum extent permitted by law, RentClear and its operators are not liable for:

  • Any HMRC penalty, surcharge, or interest arising from inaccurate, incomplete, or late submissions.
  • Loss of data caused by technical failure, provided we have taken reasonable steps to prevent such loss.
  • Any indirect, incidental, or consequential loss arising from your use of RentClear.

Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

9. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these terms, or if required by law.

On account closure, you may request export and deletion of your data as described in our Privacy Policy.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
